GENERAL INFORMATION

The General Sales Conditions refer to 4-chetta products’ online purchase, through the website: www.4-chetta.it. The website belongs to Paolorossi group Srl, and the company’s office is located on Via Ennio 6/a, Milan.

All purchase operations are governed by the Legislative Decree 185/99 and 206/05. The information concerning the conclusion of the contract is subject to Article 12 of the Legislative Decree 70/03 , while the privacy privacy data protection is adminidatrated by the Legislative Decree 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL SALES CONDITIONS

On the website www.4-chetta.it , the products sale contracts are considered concluded after the acceptance of the purchase order receipt by the Paolorossi Group Srl.

Paolorossi Group Srl will promptly notify the costumer about the receiveing of the purchase order. By proceeding with the online payment, the customer declares to have read and accepted the General Terms and Conditions of the Paolorossi Group Srl.

PERSONAL DATA

According to Article 13 of Legislative Decree 196/2003, Paolorossi Group Srl declares that all  personal and fiscal data applying to its business and directly provided by the parties involved, will be processed in compliance with the above legislation.

CUSTOMER OBBLIGATIONS

The customer shall read carefully the Sales Conditions before sending the purchase order. The placing of the purchase order involves full knowledge and acceptance of the Sale Conditions, which sould be printed out and kept in possession of the costumer after concluding the purchase.

ORDER DEFINITION

When placing the online order, the customer sends a pruduct’s purchase proposal to Paolorossi Group Srl: by doing so, the costumer accepts to buy the product at the price and terms stated in the Sales General Conditions. Paolorossi Group Srl will not accept orders if the desidered product was not on stock at the time of the order, and/or if the customer can not or does not want to pay using credit card and/or Paypal. You can place an order through the website www.4-chetta.it at the prices and conditions stated in the same, or through the authorized sellers.

PURCHASE MODALITY

The customer buys the product, which characteristics are described online on the relevant page, at the price indicated. Before placing the order, the website will display the unit cost of each product chosen, the total cost (in case it was purchased more than one product) and the relative shipping costs. Once the purchase order is placed, the customer will receive an email from Paolorossi Group Srl attesting the purchase order confirmation and containing the information on the main characteristics of the goods purchased: price, delivery costs, applicable taxes, and payment methods with a reference to the Contract General Conditions. It will also contain the information on the withdraval right existence. After approval of 4^th July 2006 Law Decree number 223“manovra bis”, amended by the Law 248 of 4^th August 2006,  Article 37 subparagraph 8 and 9 entered into force on 12^th August 2006: thus restoring the obbligation to communicate tax code and VAT number in the appropriate fields on the website.

PAYMENT

The customer can make the payment by choosing one of the following methods listed.

Payment by credit card: in the event that the consumer wishes to make payment by credit card, he may use the payment procedure with Paypal, which is suitable to ensure  the data confidentiality provided by customers. The customer is recommended to visit the site www.paypal.com for every information and additional Legal Agreements.

PRODUCT DELIVERY

The goods purchased, with its relevant invoice, it is delivered by courier to the address specified by the customer during online check out. Any special needs will have to be proposed by the customer to Paolorossi Group Srl. Paolorossi Group Srl guarantees the goods delivery within 15 (fifteen) working days, starting from the receipt confirming the transaction.

On occasion Paolorossi Group Srl, could not guarantee delivery within the above deadlines, it will be applied on additional discount of 10% on the reference 4-chetta article total cost. In the case of delivery failure for the recipient absence, at the address indicated in its order, the courier will leave a notice and try again a second time. If the recipient proves still absent, the goods will be returned to sender (Paolorossi Group Srl).

CONFORMITY WARRANTY AND DETECTIVE PRODUCTS

Products purchased on the website www.4-chetta.it are subject to the sale discipline of consumer goods. The products delivered comply with the online features described in the relevant and technical pages. Paolorossi Group Srl is liable to the customer for the conformity lacks existed at the time of goods delivery.

WITHDRAWAL RIGHT

The consumer has the right to exercise the withdrawal right.

Particulary the consumer has the right to terminate any contract with Paolorossi Group Srl, without specifyng the reason, within 10 (ten) working days from goods receipt. The withdrawal right is recognized to consumers in relation to any goods which he purchased on site www.4-chetta.it.

HOW TO EXERCISE OF WITHDRAWAL RIGHT

Withdrawal right is exercised by sending within the said period, a written communication to the Paolorossi Srl by registered letter with receipt acknowledgment. The withdrawal notice may also be sent, within the same period, by telegram or fax, provided that it is confirmed by registered mail with return receipt within 48 hours. In case of exercise of withdrawal right, the notification must be sent to the following addres:. Paolorossi Group Srl, via Giuseppe Di Vittorio, 9 – 60024 Filottrano (AN). If the goods have been delivered, the customer is required to return it to Paolorossi Group Srl within 15 (fifteen) working days from the goods delivery date. Goods must be retrurned to Paolorossi Group Srl complete with all accessories, instruction manuals and everything in origin delivered to the customer, as well packed in its original wrapping. The product must be returned together with a copy of the electronic order receipt. The goods returning costs to Paolorossi Group Srl are charged to the customer. Whether the withdrawal right is exercised by the customer in accordance with the previsions of this clause, Paolorossi Group Srl is obliged to refund the sums paid by the customer. In particular Paolorossi Group Srl will proceed to the free transmission of the charge back, relating to the costs of goods shipped, in cluding shipping costs within 30 (thirty) days from the date it become aware of trhe withdrawal right by the customer. This operation will be done through the bank used for payment, that is crediting the sum to the bank account specified by the customer. Paolorossi Group Srl has the right to reject any product returned with conditions other than those ones specified above, as well as products for which have not been fully paid the returning costs by the customer, or the ways the times given for the exercise notice of withdrawal right have not been respected.

EXPRESS TERMINATION CLAUSE

In the event of partial or total non payment of the goods purchase price, Paolorossi Group Srl reserves the right to declare, within the meaning and for the purposes of Civil Code Article 1456, solved this contract by sending a written communication to the customer electronic address.

APPLICABLE LAW AND JURISDICTION

This agreement is governed by Italian Law. The competence and exclusive jurisdiction, for any legal action brought by the purchaser under this warranty or any further legal guarantees, will be Ancona Court. In the case of Paolorossi Group Srl victory in a legal action, the plaintiff must refund the expenses to Paolorossi Group Srl, including the laywer fees and the judgment costs, sustains by Paolorossi Group Srl for his defense.

RETURN

Although not expressly provided in this agreement here are applied the current Italian Law.
